The Welsh government called for dedicated Welsh courts and judges to form a separate jurisdiction from England.
In evidence submitted to the Commission on Justice in Wales, which was established in 2017 and chaired by the former Lord Chief Justice Lord Thomas of Cwmgiedd, it suggested that lawyers from England and Wales would be able to practice in both jurisdictions.
In its submissions, the Wales and Chester Circuit backed the move, with the creation of a Court of Appeal of Wales, the High Court of Wales and the Crown Court of Wales.
The Circuit supported the devolution of powers in relation to the civil and criminal justice systems to the National Assembly for Wales and the creation of a devolved criminal legal aid system in Wales. It also supported the establishment of a Law Commission for Wales.
